1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the StockCaster.ai website, mobile applications, and any related services (collectively, the "Service") provided by StockCaster.ai ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a company or other entity, you represent and warrant you have the authority to bind that entity to these Terms.

We may modify these Terms at any time. We will post the updated version on the Service and indicate the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

3. Eligibility

5. Token Purchases & Usage

• Our pricing model uses "tokens" which you purchase and redeem for reports or other features.
• Tokens never expire but may be subject to usage limits as specified at purchase.
• Tokens are non-refundable except as required by law.
• We reserve the right to change token pricing, expiration, or terms, subject to notice as required by law.

You may use the Service only in compliance with these Terms and all applicable laws, rules and regulations.

You agree not to do any of the following:

• Use the Service for illegal or unauthorized purposes
• Modify, adapt, hack or reverse engineer any portion of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials or allow unauthorized access
• Use the Service in any way to offer competing products or services
• Use the Service to provide investment advice unless you are duly licensed and authorized

• All content, features, and functionality of the Service (including AI-generated reports, software, data, graphics, trademarks, logos and other materials) are owned by or licensed to us and are protected by copyright, trademark, patent, trade secret and other intellectual property laws.
• You may not copy, modify, distribute, sell or lease any part of the Service or its content without our prior written consent.
• If you provide feedback or suggestions, you grant us an irrevocable, perpetual, worldwide, royalty-free license to use that feedback without restriction.

• We shall not be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, revenue, data or other intangible losses) resulting from your use of (or inability to use) the Service.
• Our total cumulative liability under or relating to these Terms shall not exceed the amount you actually paid us in the preceding 12 months (if any).

You agree to indemnify, defend and hold harmless StockCaster.ai and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, losses, damages, costs or expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use of the Service; (ii) any violation of these Terms; (iii) your violation of any rights of another person or entity; or (iv) your violation of applicable law.

12. Termination

We may suspend or terminate your account or access to the Service at any time, with or without cause or notice. Upon termination: (i) all rights granted to you hereunder cease; (ii) you must stop using the Service; (iii) we may delete or disable your account and remove your data consistent with our Privacy Policy.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. You agree to resolve disputes through the courts located in Indiana and waive any right to a jury trial to the extent permitted by law.

14. Severability

If any provision of these Terms is found invalid, illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, along with any policies referenced herein (including the Privacy Policy), constitute the entire agreement between you and StockCaster.ai regarding the Service and supersede all prior or contemporaneous agreements.
